Are Employee Gifts Tax-Free in Hungary? Understanding the SZÉP Card and EMJ Rates

Hungary doesn't have a tax-free gift concept the way Germany, France, or Belgium do. There's no equivalent of Germany's Sachbezug allowance or Belgium's €40 rule where a gift under a certain value simply escapes tax. In Hungary, every employer-provided gift is taxed, full stop. What changes from one gift to the next isn't whether tax applies, it's which of Hungary's benefit categories the gift falls into, and therefore which rate applies. This article walks through the three regimes that matter: the preferential 28% rate available through the SZÉP Card, the far more common 33.04% rate that applies to most other gifts, the 32,280 HUF "small-value gift" threshold that's frequently mistaken for an exemption, and the matching rule for client gifts.

The SZÉP Card / fringe benefit rate: 28%

The most favourable route available to Hungarian employers is the "béren kívüli juttatás" (fringe benefit) framework, delivered through the SZÉP Card (Széchenyi Pihenő Kártya). Each employee has an annual ceiling of 570,000 HUF: 450,000 HUF on the general sub-account, plus a further 120,000 HUF on the "Aktív Magyarok" food sub-account introduced for active, health- and sport-related spending. Contributions within that combined ceiling are taxed at 28%, made up of 15% personal income tax (SZJA) and 13% social contribution tax (szocho), applied to the nominal value credited to the card.

That 28% is genuinely the best rate on offer in Hungary for employer benefits. But it is still nearly a third of the value handed over, not zero. Anyone advising a Hungarian employer that SZÉP Card credit is "tax-free" is simply wrong: it's taxed, just at the lowest rate the system makes available, and only up to the 570,000 HUF annual ceiling. Anything contributed above that ceiling drops out of the fringe-benefit category entirely and is taxed as ordinary wage income instead, which is worse than either of the rates covered below.

Most gifts: the 33.04% EMJ rate

Outside the SZÉP Card, the large majority of employer gifts, physical products, hampers, most non-cash benefits, fall under "egyes meghatározott juttatás" (EMJ), which translates roughly to "specific defined benefit." EMJ is taxed at an effective combined rate of 33.04%: the same 15% SZJA and 13% szocho rates as the SZÉP Card, but applied to a grossed-up base of 1.18 times the gift's actual value rather than to the nominal value itself. That gross-up is what pushes the effective rate from 28% up to 33.04%.

The other important difference is who pays. With EMJ, the tax is borne entirely by the employer, not withheld from the employee's pay. That's genuinely good for the employee, they receive the gift at full value with nothing deducted, but it means the employer's real cost is the gift's value plus roughly a third again on top. Budget accordingly: a 10,000 HUF gift under EMJ costs the company closer to 13,300 HUF once tax is included.

The "small-value gift" threshold: still taxed, just safer

Hungarian tax law also recognises a "csekély értékű ajándék" (small-value gift): up to 32,280 HUF per occasion, equal to 10% of the 2026 minimum wage of 322,800 HUF per month, and available up to three times per year per recipient. It's tempting to read that as a tax-free allowance. It isn't. A small-value gift is still taxed at the full 33.04% EMJ rate described above; the threshold doesn't reduce the rate or exempt any part of the value.

What the threshold actually does is protect the gift from being reclassified as something worse. Exceed 32,280 HUF on a single occasion, or give more than three such gifts to the same person in a year, and the gift risks being treated as ordinary taxable income or wages instead of EMJ, which typically means a higher effective burden and, unlike EMJ, tax withheld from the employee rather than absorbed by the employer. So the small-value gift rule is a safe-harbour ceiling that keeps you inside the 33.04% EMJ treatment, not an exemption that gets you out of tax altogether.

Client gifts: same 33.04% rate applies

Gifts to clients and other business contacts in Hungary follow the same EMJ regime as most employee gifts, not a separate, more lenient one. The combined 33.04% rate applies in exactly the same way, and the cost is borne entirely by the giving company. There's no VAT input deduction available on the gift itself. Where a client gift does get favourable treatment is on corporate tax: it's deductible for Tao (corporate income tax) purposes as a recognised business expense, provided it's genuinely business-connected and properly documented, a marketing or relationship-building cost tied to an identifiable business purpose, rather than, say, a personal favour routed through company books.

Common mistakes

  • Assuming any Hungarian gift can be truly "tax-free." It can't. Every route, SZÉP Card, EMJ, small-value gift, carries a tax charge; the only variable is which rate applies.
  • Confusing the SZÉP Card 28% rate with the more common 33.04% EMJ rate. The 28% rate only applies to fringe-benefit contributions within the 570,000 HUF SZÉP Card ceiling. Most other gifts, including anything under the small-value gift rule, sit at 33.04%.
  • Assuming client gifts are treated more favourably than employee gifts. They aren't. Client gifts are taxed identically to most employee gifts under the same 33.04% EMJ rate; the only real difference is the corporate tax deductibility angle, not the gift tax rate itself.
