Tax-Free Employee Gifts in Denmark: The Bagatelgrænse Explained

Denmark's tax-free gift rules for employees aren't a single number — they're layered. A separate limit covers the Christmas gift (julegave), a broader annual cap covers all other small workplace perks combined, and a completely different rule governs service-anniversary payments. Mixing these up is the most common way Danish employers accidentally create a taxable benefit. Here's how each piece actually works.

The Christmas gift limit: 1,000 DKK

The julegave has its own dedicated threshold: if the Christmas gift alone costs 1,000 DKK or less, it stays tax-free for the employee, full stop. Crucially, this holds true even if the gift, added to everything else the employee has received during the year, would push their combined total of minor workplace benefits above the broader 1,400 DKK cap described below. The Christmas gift is evaluated on its own, in isolation, against its own 1,000 DKK ceiling.

That makes it the most reliable, most "protected" gift-giving moment on the Danish calendar: as long as you keep the julegave itself at or under 1,000 DKK, it's tax-free regardless of what else has already gone out the door to that employee that year.

The bagatelgrænse: 1,400 DKK combined annual cap

Alongside the Christmas gift sub-limit sits a separate, broader rule: the bagatelgrænse for mindre personalegoder. This is the total combined value of all minor non-cash workplace benefits an employee can receive tax-free in a calendar year, occasional flowers, a bottle of wine, small thank-you gifts, and (importantly) any part of a Christmas gift that costs more than 1,000 DKK.

The mechanic to watch is the cliff edge: if the combined value of everything in this pool exceeds 1,400 DKK across the year, the entire value of all those benefits becomes taxable, not just the amount over the cap. A year with 1,450 DKK of small gifts and flowers is taxed on the full 1,450 DKK, not the 50 DKK excess.

Here's how the two limits interact:

  • A Christmas gift of 1,000 DKK or less never enters this 1,400 DKK pool at all. It's protected by its own sub-limit, independently, no matter what else happens with the bagatelgrænse elsewhere in the year.
  • A Christmas gift costing more than 1,000 DKK loses that protection: its full value (not just the excess over 1,000) is added into the 1,400 DKK combined pool alongside every other minor benefit the employee received that year.
  • If that combined pool then exceeds 1,400 DKK, everything in it, flowers, wine, small gifts, and the now-unprotected Christmas gift, becomes taxable in full.

In short: stay at or under 1,000 DKK on the julegave and it's untouchable. Go over, and it's thrown into the same bucket as everything else, where the 1,400 DKK ceiling applies to the whole lot.

Cash and gift cards don't count

Neither of the limits above helps with cash. Cash gifts are always fully taxable, at any amount, and they don't even benefit from the bagatelgrænse mechanism, they're taxed as ordinary income regardless of how small they are.

Standard, electronic gift cards are treated the same way as cash and are always taxable, since they can typically be spent almost anywhere and converted to value at will.

There is one narrow exception: a physical gift card restricted to a single retailer, or otherwise restricted in how it can be used (not electronically cashable, not exchangeable across a wide network of merchants), may still qualify for tax-free treatment, but only if that use is "sufficiently restricted." A generic prepaid card or an app-based gift card that works almost anywhere will not meet that bar.

The anniversary gift rule: 8,000 DKK

Separate from all of the above is the jubilæumsgratiale, an anniversary payment or gift tied to an employee's length of service. Under Ligningsloven §7U, this is tax-free up to 8,000 DKK; only the amount above 8,000 DKK is taxed, so unlike the bagatelgrænse, there's no cliff edge here, going over just means the excess is taxed, not the whole amount.

To qualify, the employee must have reached 25 or 35 years of service, or a further milestone divisible by 5 after that (40, 45, and so on).

A related, company-wide variant exists too: when the company itself is marking its 25th anniversary, or a multiple of 25 years in existence, it can pay an equal bonus to all staff under the same 8,000 DKK threshold.

What about client gifts?

Gifts to clients and business contacts sit under a different, stricter regime. As a general rule, client gifts are not deductible for corporate tax purposes in Denmark.

There's one meaningful exception: reklameartikler (promotional or advertising items). These are fully deductible as an advertising expense, but only if all three conditions are met:

  • The item costs 100 DKK or less, excluding VAT.
  • It's conspicuously marked with the company's name or logo.
  • It's distributed broadly and in bulk, not handed out to a narrow, hand-picked list of recipients.

Miss any one of those conditions, the item costs more than 100 DKK, carries no branding, or goes only to a small selected group, and it's reclassified as either a non-deductible gift or a "representation expense," which is only 25% deductible.

VAT (moms) follows a parallel logic. The general rule is no VAT deduction on gifts (Momsloven §42, stk. 1, nr. 5). The same reklameartikler test applies as an exception: an item priced at 100 DKK or less excluding VAT, clearly branded, and distributed as marketing material allows full VAT deduction.

In practice, this is exactly why branded merchandise under the 100 DKK ex-VAT line, pens, stickers, small desk items, is such a popular corporate gift in Denmark: it's the one category that's fully deductible on both counts.

Common mistakes

  • Confusing the Christmas gift sub-limit with the overall bagatelgrænse. A 1,000 DKK julegave is protected on its own; it's only when it exceeds 1,000 DKK that it gets folded into the 1,400 DKK combined pool with everything else.
  • Assuming a standard gift card qualifies as tax-free. Electronic, general-purpose gift cards are treated as cash and are always taxable, only a physical, genuinely restricted-use card has a chance of qualifying.
  • Missing the service-length requirement for the jubilæumsgratiale. The 8,000 DKK anniversary allowance only applies at 25, 35, 40, 45 years (and further 5-year milestones) of service, an anniversary that doesn't land on one of those years doesn't qualify for this rule at all.
