The ≈10%-of-average-salary gift exemption
Moldova's Fiscal Code (Art. 20, letter c2) provides a genuine statutory tax exemption, not just an administrative courtesy, for in-kind gifts an employer gives to employees, or to employees' minor children. This includes gift vouchers, as long as they're not paid out as cash.
The exemption is capped at 10% of the officially forecast average monthly salary on the economy, a figure the Moldovan Government sets each year. For 2026, the forecast average monthly salary is 17,400 MDL, which puts the exemption ceiling at approximately 1,740 MDL per employee, per year. Because this figure moves annually with the government's forecast, it's best described as "≈10% of the current average salary" rather than treated as a fixed number you can reuse from one year to the next.
A few mechanics worth understanding before you budget for gifting:
- In-kind only. The exemption applies exclusively to in-kind gifts and vouchers. Cash gifts or bonuses are ordinary taxable income, fully subject to income tax and payroll contributions just like regular salary, with no exemption whatsoever.

What about client gifts?
The employee gift exemption above does not extend to clients, suppliers, or other business partners. Gifts to external parties fall under a separate "representation expenses" regime in the Fiscal Code.
Representation expenses, covering the official reception of business delegations and gifts or souvenirs given to delegation members, are deductible for the business as a whole up to 0.75% of gross income (venit brut). Within that overall cap, there's a per-recipient sub-cap: gifts or souvenirs to each individual recipient are only deductible up to 2% of the annual personal exemption, which works out to approximately 594 MDL (≈€30) per recipient, per applicable event.
In practice, this means client and partner gifting operates under a much tighter, and structurally different, set of limits than employee gifting. Don't assume the employee exemption rules apply to business-partner gifts, they don't.
VAT on promotional gifts
A separate rule applies to goods or services handed out free of charge for advertising or sales-promotion purposes, branded merchandise given away at a trade show or as part of a marketing campaign, for example. These are not treated as a taxable object for VAT purposes, up to an aggregate ceiling of 0.5% of the taxpayer's prior-year sales revenue.
This is an annual aggregate cap tied to the giver's total turnover, not a per-item or per-recipient threshold, so it's worth tracking cumulatively across all promotional giveaways in a given year rather than checking it gift-by-gift.
Common mistakes
- Giving a cash gift and assuming it qualifies for the exemption. It never does. Only in-kind gifts and vouchers are eligible; cash gifts and bonuses are taxed as ordinary salary income from the first leu.
- Gifting outside the qualifying occasions and assuming it's still exempt. Only gifts given on the official statutory holidays or on an employee's birthday qualify. A gift for any other occasion is fully taxable, regardless of value.
- Confusing the employee-gift exemption with the client/representation-expense rules. The two regimes have different caps, different mechanics, and different eligible recipients. Applying the employee ceiling to a client gift (or vice versa) will misstate your tax position.
