If you've read about Germany's Sachbezug allowance, France's URSSAF tolerance, or Belgium's flat gift ceilings, you might expect Spain to work the same way: a clean euro figure under which a gift to an employee is simply tax-free. It doesn't. Spain has no flat exemption for employee gifts. The value of almost any meaningful gift to staff is treated as ordinary taxable income, just like salary. Here's what Spanish law actually says, what genuinely is exempt, and how the rules differ for gifts to clients.
Why the Christmas hamper isn't "tax-free"
Under Article 42 of the Ley del IRPF (Spain's personal income tax law), a Christmas hamper, gift card, or electronic device given to an employee is legally classed as retribución en especie ("payment in kind"). That classification has two direct consequences.
- It's added to taxable income. The market value of the gift is added to the employee's taxable salary and reported via modelo 111 (the employer's periodic tax-withholding declaration), exactly as if it were a cash bonus.
- It's usually subject to Social Security contributions too. Unless the gift falls under one of the specific exempt categories below, its value is generally also liable for Social Security contributions, on top of the income tax effect.
There is no general "de minimis" amount that shields these gifts from taxation. That's a meaningful difference from Germany's Sachbezug allowance or the Netherlands' vrije ruimte, both of which carve out a flat tax-free band for exactly this kind of gift. In Spain, the starting assumption is the opposite: if a gift has real value and it goes to a named employee, assume it's taxable unless a specific rule says otherwise.
What's actually exempt: flexible remuneration
Spain does recognize a closed list of in-kind benefits that are exempt from IRPF under Article 42.3 LIRPF. These aren't "gifts" in the traditional sense. They're usually delivered through a flexible remuneration ("retribución flexible") plan, where the employee allocates part of their own salary package toward them. But they're the real, legal way to give an employee added value without triggering extra taxation:
- Restaurant card or voucher: exempt up to €11/day.
- Public transport pass: exempt up to €1,500/year.
- Health insurance: exempt up to €500/year per person (employee, spouse, and children), rising to €1,500/year if there's a disability.
- Nursery/childcare vouchers: 100% exempt for children under 3, within reasonable, justified limits.
- Company shares: exempt up to €12,000/year, under certain conditions.
If your goal is to reward employees without creating a tax bill, these categories, not merchandise gifts, are where the real, codified exemptions live in Spain.

The honest reality is that a branded merchandise gift of meaningful value will usually count as retribución en especie if it's given individually and carries significant value. Article 15.e of the Ley del Impuesto sobre Sociedades (LIS, Spain's corporate tax law) allows companies to deduct client and supplier entertainment expenses, "atenciones a clientes o proveedores," up to 1% of the company's net turnover ("importe neto de la cifra de negocios," INCN) for the fiscal year.
Unlike the employee regime, there's no per-gift cap. What matters is the aggregate of representation-type expenses compared to the company's overall turnover for the year. Any amount above that 1% ceiling isn't deductible, and must be recorded as a positive adjustment ("ajuste extracontable positivo") in the corporate tax return.

Common mistakes
- Assuming a flat exemption exists, like in Germany. Spain has no equivalent to the Sachbezug allowance: there is no blanket euro threshold under which employee gifts are automatically tax-free.
- Confusing the 1% INCN client-gift cap with a per-gift limit. The 1% rule is an aggregate ceiling measured against total turnover, not a maximum value per individual gift.
- Not declaring meaningful-value employee gifts via modelo 111. If a gift has real, individually-attributed value and doesn't fall under one of the flexible-remuneration exemptions, it needs to be reported as retribución en especie, not quietly left off the books.
